APPENDIX 1 – DEFINITIONS AND INTERPRETATION

 

1.                   INTRODUCTION AND INCORPORATION OF TERMS

1.1               These Regulations set out the rules and regulations for the staging of the Championship and apply to each Participant.

1.2               The Championship is staged on the Platform, and accordingly the Official Sporting Code of the Platform (the “Sporting Code”), Terms of Use and End User Licence Agreement    the Platform and Broadcast Policy of the Platform (together the “Platform Documents”) are incorporated into these Regulations and apply to each Participant.

1.3               In the event of a conflict between these Regulations and any of the Platform Documents, these Regulations shall take priority.

1.4               Please note that in respect of the processing of personal data in connection with the Championship:

1.4.1            the Privacy Policy of the Platform describes how personal data is collected and processed on the Platform; and

1.4.2           the Privacy Policy of the Championship describes how personal data is collected and processed by the Organiser and Porsche in connection with the operation of the Championship.

2.                   ORGANISATION OF THE CHAMPIONSHIP

2.1               The Championship consists of four Championship Events, with each Championship Event consisting of one Qualifying Session and two Races, as further detailed in Regulations 5 and 6. The Championship shall have two separate Classifications, the pro Classification and the amateur Classification.

2.2               The dates and virtual circuits for each Championship Event are as follows:

2.3               The Organiser reserves the right to cancel or relocate a Championship Event or individual Events without any liability to any Participant.

2.4               The Organiser is solely responsible for all aspects of the staging and operation of the Championship and all questions and queries regarding the Championship should be directed to the Organiser at: [email protected]. Accordingly, each Participant acknowledges and agrees that:

2.4.1               Porsche shall have no liability in respect of the Championship and its operation (save for any breach by Porsche of the licence set out in Regulation 10.3);

2.4.2               each Participant’s sole recourse in respect of any matter arising out of or relating to the Championship and these Regulations (save for any breach by Porsche of the licence set out in Regulation 10.3) shall be to the Operator; and

2.4.3               nothing in this Regulation 2.4 shall affect Porsche’s ability to rely on the licence set out in Regulation 10.3.

3.                   REGISTRATION

Registration Process – Championship Events

3.1               In order to participate in the Championship Events a Driver must:

3.1.1               be a legal resident of the United Kingdom;

3.1.2               be at least 18 years of age;

3.1.3               not have ever competed in either the Porsche TAG Heuer Esports Supercup or Porsche Esports Carrera Cup GB;

3.1.4               own at the time of registration and continue to own throughout the Championship, a Motorsport UK Esports paid membership (£24.99 for a 12-month membership);

3.1.5               complete and sign the Application for Driver Entry (on behalf of themselves and any other members of their team) and submit it to the Organiser at [email protected] on or before 23.59 on Monday 2nd October (or, in respect of Waiting List Drivers and Guest Drivers, such time and date as is notified by the Organiser to the applicable Waiting List Driver or Guest Driver);

3.1.6               Complete the ‘Register’ process for the Championship on the SimGrid Website. This includes choosing either the pro or amateur Classification in accordance with Regulation 6.1;

3.1.7               ensure that the Application for Driver Entry is provided complete with full car design and livery specifications, designed within the Platform and compliant with Regulation 10.1, as a vector file (.eps or .ai);

3.1.8               have registered an account on the Platform (and include their Platform ID within their Application for Driver Entry);

3.1.9               not have an iRacing licence lower than Class D 2.0;

3.1.10            not be persons designated by OFAC as Specially Designated Nationals; and

3.1.11            have been invited to particate in the Championship Event under Regulation 3.2.

3.2               An Application for Driver Entry shall be determined by the Organiser in its sole discretion and the Organiser will provide a confirmation email to any person whose Application for Driver Entry is successful and who is accordingly invited to participate in the Championship Events. Each Championship Event will have up-to twenty (20) registered Drivers (for the avoidance of doubt, this is twenty (20) Registered Drivers in each of the professional and amateur Classifications).  

3.3               Please note that the Organiser reserves the right to invite Guest Drivers to any of the Races or Events that take place during the Championship.

Entry fees for the Championship

3.4               There will be no registration/entry fees for Participants for competing in the Championship, but, as per Regulation 3.1.3, all Registered Drivers are required to have a paid Motorsport UK Esports membership.

4.                   OPERATION OF EVENTS – GENERAL

4.1               League

Each Championship Event shall be staged as a ‘Hosted Session’ (“Session”) within the Platform with the overall Championship taking the form of a league. All Registered Drivers shall receive invites to join Sessions and/or the league.

4.2               Conduct of Races

Each Race shall be conducted in accordance with, and shall be subject to the rules of, the Sporting Code and the Motorsport UK Race with Respect Code of Conduct

4.3               Race timing and weather

All Races will be staged using automatically generated weather and dynamic sky. The date will be set to the date of the Race plus six months, while the time of day will be set as follows:

Race 1: Morning

Race 2: Afternoon

4.4               Setup

All cars in the pro and amateur Classification will have fixed setups. All Drivers  will be provided the fixed set up (as well as confirmation of any adjustable settings) reasonably in advance of a Championship Event.

5.                   OPERATION OF EVENTS – Qualifying session

5.1               General

5.1.1               The Qualifying Session for each Championship Event shall take place before the first Race of a Championship Event. The Qualifying Session shall consist of one lone session of 10 minutes in duration, whereby the Driver shall have 10 minutes to set a qualifying time over a maximum of two laps.

5.1.2               Each Qualifying Session shall have a maximum of 20 Drivers in each Classification,.

5.1.3               The qualifying time from the Qualifying Session shall determine the grid order for the first Race of a Championship Event. For the second Race of each Championship Event the grid positions will be determined by the finishing grid order of the first Race of the Championship Event. For example, if a Registered Driver finishes third in the first Race, he shall start the grid from third position for the second Race.

6.                   OPERATION OF EVENTS – CHAMPIONSHIP EVENTS

6.1               Commitment to participate

6.1.1               Each Registered Driver shall use all reasonable endeavours to fully participate in each Championship Event.

6.1.2               If a Registered Driver is unable to participate in a Championship Event for any reason then they must (where it is possible to do so) notify the Organiser at least 24 hours in advance of the Championship Event. In such circumstances the applicable Registered Driver shall be replaced by a Waiting List Driver on the Waiting List at the time of the disqualification or by a Guest Driver (at the discretion of the Organiser).

6.1.3               Please note that Regulation 8.3.2 shall apply where a Qualifying Driver is unable or does not participate in two or more Championship Events.

6.2               Classifications

A Driver will be classified in the professional Classification if, on the day of registering, they have ever reached an iRating on iRacing of 3,500 or more. If a Driver has never reached an iRating on iRacing of 3,500 or more, they shall be classified as an amateur.

6.3               Start times

All Championship Events are held on a Sunday and will start at 18:00 UK time.

6.4               Championship numbers

Each Registered Driver participating in the Championship Events will be allocated a Championship number by the Organiser, which will apply for all Championship Events. Where a Driver has requested that they be allocated a specific Championship number in their Application for Driver Entry, the Organiser shall consider such request but shall ultimately determine the number to be allocated in its sole discretion. Each Registered Driver is responsible for the proper configurating of their Championship number within the Platform prior to the start of the first Championship Event in which they participate. Registered Drivers will also be assigned start numbers for each Championship Event.

6.5               Minimum and maximum number of cars

Each Championship Event shall feature a maximum of 20 cars (with the 20 cars being Cup Cars for the professional Classification and GT4 Cars for the amateur Classification).

6.6               Event Settings

Every Championship Event’s free practice sessions will be staged using the same in-game date and time of day as the Race session.

6.7               Free Practice Session

There will be a four-hour free practice session on two days prior to the Race day – on the Wednesday and Saturday from 18:00 to 22:00 UK time. Registered Drivers are allowed to enter and exit the pitlane as they please or jump directly to the pits when stopping safely on track.

6.8               Qualification

The qualifying session for each Championship Event, to determine the starting positions of each Qualifying Driver in Race 1, will last for 10 minutes and a maximum of two laps. The session will be set to lone-qualifying. Qualifying Drivers are allowed to enter and exit the pitlane as they please or jump directly to the pits when stopping safely on track.

6.9               Races

6.9.1               Each Championship Event will consist of two Races. Each Race is time-based and set to a duration of 40 minutes. Drivers will be shown the white flag at the start of their last lap, once the Race leader has crossed the line with insufficient time remaining to complete more than one lap before the time expires.

Race 1:

(a)              Championship Points awarded for finishing order in Race 1.

(b)             Race 1’s finishing order will determine starting order of Race 2.

Race 2:

(a)              Grid determined by finishing order from Race 1.

(b)             Champions Points awarded for finishing order in Race 2.

6.10           Event Timetable.

The following table shows the typical timetable for each Championship Event (with both Classifications taking place simultaneously). All times are UK time. The Organiser will notify all Registered Drivers by email and/or Discord if there is a material change to any of the timings set out below.

  • Practice - 6:00pm BST
  • Qualifying - 7:00pm BST - (Lone Qualifying, 2 Laps, 10 Minutes)
  • Race 1 - 7:15pm - 7:45pm BST
  • Race 2 - 8:00pm - 8:30pm BST

7.                   SETUP AND TYRES

7.1               Tyres

7.1.1               Each Registered Driver will have an unlimited number of tyres for each Championship Event.

7.1.2               In respect of free practice and Qualifying Sessions, Registered Drivers will be able to leave the pits with a fresh set of tyres and an undamaged car every time they leave the pitlane.

7.1.3               In respect of Races, each Registered Driver will start each Race with a fresh set of tyres and may elect to change their tyres, refuel and/or repair the car during a Race (but the car will not, unless it is repaired, leave the pitlane with any damage sustained prior to the pitstop having been repaired). In both Classifications, all Drivers will be allocated one fast repair to use during each Race.

8.                   AWARDING OF POINTS AND PRIZES

8.1               The winner

The winner of each Race is the Driver who is in first position at the end of the Race (once it is completed in accordance with Regulation 6.9.1), taking account of all penalties.

Championship Points will be awarded for the position of each Registered Driver (taking account of any penalties incurred) at the end of each Race as follows

 So, for example, a Registered Driver who finished first in Race 1 and third in Race 2 in a particular Championship Event would receive a total of 42 Championship Points for such Championship Event (subject to any penalties).

Additionally, one Championship Point is awarded to each Registered Driver who sets the fastest lap time in each of the Qualifying Session, Race 1 and Race 2, respectively (meaning an additional three Championship Points in total are available during each Championship Event).

8.3               Driver Classification

8.3.1               All results of the individual Championship Events count towards the Overall Classification, and there are no void or ‘dropped’ results. The Overall Classification is listed separately from the classification of each Race and represents the aggregate of all Championship Points awarded to each Registered Driver over the course of the entire Championship. The winner of the Championship is the Registered Driver with the highest number of Championship Points in the Overall Classification after the completion of the final Championship Event.

8.3.2               The Registered Driver named in the Application for Driver Entry must take part in a single Championship Events in order to be included in the final Overall Classification for the Championship.

8.4               Overall winner

The winner of the Championship is the Registered Driver with the highest number of Championship Points in each Classification after the completion of the final Championship Event and they will be awarded the title: “Porsche Esports Sprint Challenge GB Champion2023”.

8.5               Prizes

8.5.1               Prizes are awarded following the final Championship Event for the Qualifying Drivers with the first, second and third-highest Championship Points scored in the Overall Classification as follows:

9.                   JUDICIAL PROCEDURES AND PENALTIES

9.1               Race Review

9.1.1               All Race results are preliminary until the Stewards have reviewed the Race start(s) and all protested incidents. Following this review, the Stewards will apply penalties, when appropriate, and will accordingly adjust the Race result if applicable.

9.1.2               Stewards may award warnings, time penalties, qualifying bans (meaning that the applicable Qualifying Driver must start a Race at the back of the grid) as well as disqualifications and exclusions from future Championship Events (or from the Championship altogether).

9.1.3               The Stewards have absolute discretion to issue penalties according to the severity of the incident in question and, in respect of time penalties, the list of further sanctions set out in Regulation 9.5 shall also apply.

9.2               Incident Points

9.2.1               Every Race will utilise the Platform’s incident monitor, and will impose an Incident Point Limit to monitor track limits as well as driving standards in general. If a Registered Driver incurs more than 20 Incident Points in all Races in any single Championship Event this will result in an automatic drive through penalty. A drive through penalty will also be incurred every 10 Incident Points after the first drive through penalty.

9.3               Protests

9.3.1               Any Driver that is involved in or affected by an incident that occurs during an Event may file a protest to the Stewards using the Protest Form. Every protest must be submitted via the Protest Form and must include the car number of the protesting Driver, the car number of the Driver (or Drivers) in respect of whom the protest is being made, the Session and (in the case of a Race) lap in which the incident occurred as well as a brief description of the incident itself.

9.3.2               The deadline to submit protests is 22:30 UK time on the date of the applicable incident (the “Protest Submission Deadline”).

9.3.3               By participating in the Championship, every Participant agrees to accept the decisions of the Stewards, which are final. In particular, there is no form of appeal to Porsche or any other body.

9.4               Incident Summary Report

9.4.1               After being reviewed by the Stewards, the outcomes of all protests, potential penalties as well as the official Race results will be published in the form of an incident summary report. This report will be published no later than 24 hours after the Protest Submission Deadline.

9.4.2               All protest outcomes published in the incident summary report are final and may not be appealed.

9.5               Penalty System

9.5.1               In addition to their ability to issue a qualifying ban and/or disqualify Drivers, the following penalties may be used by the Stewards depending on the severity of the incident:

(a)              Warning

(b)             5 second time penalty added to Race time

(c)              10 second time penalty added to Race time

(d)             15 second time penalty added to Race time

(e)              20 second time penalty added to Race time

(f)               25 second time penalty added to Race time

(g)              30 second time penalty added to Race time

9.5.2               In addition to the time penalties set out in Regulation 9.5.1 that will apply to a single Race, all time penalties are tracked over the course of the Championship and additional sanctions may be imposed where a Registered Driver’s cumulative time penalties over the course of the Championship (including all Events) meet or exceed certain thresholds, as follows:

10.1.1            Registered Drivers must submit their own liveries for their cars (“Liveries”) to the Organiser via the Livery Upload Folder in the Motorsport UK Esports Discord on or before 11:59pm GMT  September 28th 2023 (the “Livery Deadline”). The Organiser provides no guarantee that any Livery submitted after the Livery Deadline shall be considered for inclusion in the Championship. Any Driver who submits their Livery late or in a manner that is not compliant with these Regulations may be required by the Organiser to use a car that includes no branding other than that provided by the Organiser.

10.1.2            A Livery must comply with the following principles (and any further principles set out in the Application for Driver Entry):

(a)              the official Championship livery decal layer will be applied to all competing cars. Therefore, no logos or branding should clash with the decal layer. The decal layer can be found in the Motorsport UK Esports Discord server;

(b)             the Registered Driver must have written permission from the property owner for use in the Championship of any logo or copyrighted material on a livery;

(c)              all liveries used must adhere to the iRacing Paint Policy found here (https://bit.ly/iracing-paint-policy); and

(d)             any political, offensive, defamatory, harmful or otherwise indecent material on a custom livery will result in the Registered Driver being banned from the Championship.

 

10.2           Promotional Obligations

Each Driver shall participate in such promotional obligations relating to the Championship as reasonably requested by the Organiser from time to time.

10.3           Grant of licence

10.3.1            Each Participant grants to the Organiser and Porsche a worldwide, irrevocable, perpetual, sub-licensable, transferable, royalty-free right and licence to use:

(a)              such Participant’s name, nickname, image, likeness, biography, signature, voice and film and photographic portrayal, virtual and/or electronic representation, reputation, replica, relevant racing statistics and all other characteristics and attributes of the Participant;

(b)             in the case of Drivers, the Livery provided by them for use in the Championship (and any logos, trade marks, service marks (including of sponsors) or other material incorporated in such Livery); and

(c)              any audio, visual or audio-visual materials produced during or after the Championship that feature the Participant and/or any of the materials listed above in this Regulation 10.3.1,

in each case for the following purposes.

(d)             in connection with the transmission (via any medium) of coverage of the Championship;

(e)              in advertising and promotional material for Porsche, the Championship, the real-world Porsche Sprint Challenge GB (the “RW Championship”) or future championships operated in association with the Porsche brand (such as television promotions, posters and advertising); 

(f)               in advertising and promotional material produced by or on behalf of the commercial partners of the Championship and/or Porsche, the RW Championship and/or future championships operated in association with the Porsche brand from time to time (such as print advertising, outdoor advertising, point of sale advertising, trade-on-trade promotions, programming and website material) to promote their association with the Championship, Porsche, the RW Championship and/or future championships administered by Porsche, in each case provided always that no such use shall suggest individual endorsement by that Participant of the products or services of any of such commercial partners;

(g)              on merchandising or other marketing material relating to the Championship or future championships administered by Porsche; and

(h)             in connection with (and including within) interactive computer games and/or video games (including for the purposes of esports activities in any media).

10.3.2            For the avoidance of doubt, the licence granted in Regulation 10.3.1 shall survive the termination or expiry of the relevant Participant’s participation in the Championship.

10.3.3            Each Participant hereby represents and warrants that:

(a)              the exercise of the rights under Regulation 10.3.1 by the Organiser and/or Porsche (and any other third parties that the Organiser and/or Porsche licenses such rights to) shall not infringe the rights, including the intellectual property rights, of any third party; and

(b)             it has all rights, licences and permissions necessary from the relevant third parties in order to grant the rights set out in Regulation 10.3.1.

11.               GOVERNING LAW AND DISPUTES

11.1           These Regulations shall be governed by and construed in accordance with English law.

11.2           Any dispute arising out of or in connection with these Regulations shall be referred to Sport Resolutions (UK) (a trading name of The Sports Dispute Resolution Panel Ltd – Company No. 3351039) for final and binding arbitration in accordance with the Arbitration Act 1996 and Sport Resolutions (UK)’s Arbitration Rules, which Rules are deemed to be incorporated by reference to this Regulation 11.

APPENDIX 1 – DEFINITIONS AND INTERPRETATION

1.                   The following terms shall have the following meanings when used in these Regulations:

Application for Driver Entry” the application form for entry into the Championship provided by the Organiser;

Championship” means the Porsche Esports Sprint Cup GB 2023;

Championship Event” means each round of the Championship consisting of one Qualifying Session and two Races, the format of which is set out in Regulation 6.10;

Championship Points” means points allocated depending on a Qualifying Driver’s finishing position at the end of a Race, as further detailed in Regulation 8.2;

Classification” means, as the context requires, the professional classification and/or the amateur classification;

Driver” means any person who competes in the Championship from time to time as a driver of a sim-racing car;

Event” means, as the context requires, a Qualifying Session and/or a Race;

Guest Driver” means any Driver who is invited by the Organiser to participate in the Championship (or any Championship Event) without having applied through an application for Driver Entry;

Incident Points” means the system within the Platform that identifies incidents of poor or dangerous driving and allocates penalties accordingly;

Incident Point Limit” has the meaning given in Regulation 9.2.1;

Livery” has the meaning given in Regulation 10.1.1;

Livery Deadline” has the meaning given in Regulation 10.1.1;

Organiser” Motorsport UK Association Limited;

Overall Classification” means, in relation to each classification, the overall Championship Points standings for the Championship in aggregate across all Championship Events;

Participant” means any Driver and any member of their support team, as detailed on the Application for Driver Entry;

Platform” means the iRacing sim-racing platform;

Platform Documents” has the meaning given in Regulation 1.2;

Protest Form” means the protest form available from the Organiser on request;

Porsche” means Porsche Cars Great Britain Ltd, a company registered in England with its registered address at Bath Road, Calcot, Reading, Berkshire RG31 7SE (and any other affiliates of Porsche Cars Great Britain Ltd and/or members of its group of companies);

Protest Submission Deadline” has the meaning given in Regulation 9.3.2;

"Qualifying Session” means the qualifying session to determine the starting grid order for the first Race of each Championship Event, which shall take before the first Race of the Championship Event;

Registered Driver” means a Driver who has been invited by Porsche to participate in the Championship and subsequently registers for the Championship on the SimGrid Website;

Regulations” means these rules and regulations for the Championship, including the Appendices;

"Race” means a race which forms part of a Championship Event;

RW Championship” has the meaning given in Regulation 10.3.1(e);

Session” has the meaning given in Regulation 4.1;

"SimGrid Website” means the following website: https://www.thesimgrid.com/

Steward” means an official steward of the Championship and/or a Championship Event, as appointed by the Organiser from time to time in its sole discretion;

Waiting List” means the waiting list of drivers who were unsuccessful in their application to participate in the Championship but who were selected to be on a waiting list of Waiting List Drivers; and

Waiting List Driver” means a Driver who is invited by the Organiser to participate in the Championship having been on the Waiting List.

2.                   The following rules of interpretation apply to these Regulations:

2.1               any obligations imposed on a "Driver" in these Regulations include an obligation on that Driver to procure such obligation is complied with by any employees (direct or indirect), consultants, agents, team members or third parties acting on that Driver’s behalf (including any other Participants named on such Driver’s Application for Driver Entry), and that Driver shall be primarily liable for any breach of any of these Regulations by any of the foregoing;

2.2               use of the singular includes the plural and vice versa and words importing any particular gender shall include all other genders;            

2.3               any reference to a statute, statutory provision, subordinate legislation, code or guideline ("legislation") is a reference to such legislation as amended and in force from time to time and to any legislation that re-enacts or consolidates (with or without modification) any such legislation;

2.4               any reference to a document, agreement, regulation, code or equivalent shall be to that document, agreement, regulation, code or equivalent as amended, varied or restated from time to time;

2.5               any phrase introduced by the terms "including", "include", "such as" "in particular" or any similar expression shall be construed as illustrative and shall not limit the sense of the words preceding those terms;

2.6               in writing includes by email unless otherwise indicated; and

2.7               the Appendices form part of these Regulations and shall have effect as if set out in full in the body of these Regulations and any reference to these Regulations includes the Appendices. 

3.                   Any notice to be provided to a Participant in writing shall be sent by email to the email address for that Participant set out on the Application for Driver Entry. Any such email shall be deemed delivered on the date and at the time it is sent.

4.                   Any references in these Regulations to consent or approval to be given by the Organiser shall be determined by the Organiser in its absolute and sole discretion and no decision shall be considered to be setting a precedent for any future decision of the Organiser.

(a) If any provision of these Regulations shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Regulations, which shall remain in full force and effect.  (b) If any provision of these Regulations is so found to be invalid or unenforceable but would be valid or enforceable if some part of the provision were deleted, the provision in question shall apply with such deletion(s) as may be necessary to make it valid.  (c) In the circumstances referred to in paragraph (a) and if paragraph (b) does not apply, the Organiser shall attempt in good faith to substitute for any invalid or unenforceable provision a valid or enforceable provision that achieves to the greatest extent possible the same effect as would have been achieved by the invalid or unenforceable provision.
